Welcome to The Providence Forge. These Terms of Service (“Terms”) govern your access to and use of
our website at www.theprovidenceforge.com
(the “Site”), and any products or services you purchase from us (collectively, the “Services”).
By accessing the Site or placing an order, you agree to these Terms. If you do not agree, do not use the Site or Services.
1. Agreement to terms
These Terms form a legally binding agreement between you and The Providence Forge
(“we,” “us,” or “our”). They apply to all visitors, users, and customers.
Additional policies (including our Privacy Policy, Shipping Policy, and Refund/Return Policy)
are incorporated by reference and form part of this agreement where applicable.
If you use the Site on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
2. Eligibility and age
You must be at least the age of majority in your place of residence (and in any event at least 18 years old)
to purchase products from us. By using the Site, you represent that you meet these requirements and that
any information you provide is accurate and complete.
Parents or legal guardians who purchase for minors remain fully responsible for the order and for compliance with these Terms.
3. Accounts and security
You may browse as a guest or create a customer account. If you create an account, you are responsible for
maintaining the confidentiality of your login credentials and for all activity under your account.
Notify us promptly at admin@theprovidenceforge.com
if you suspect unauthorized use.
We may refuse service, close accounts, or cancel orders at our discretion if we reasonably believe these Terms have been violated,
fraud is suspected, or information provided is incomplete or inaccurate.
4. Products, descriptions, and pricing
We offer apparel, journals, prints, and related goods through our Shopify storefront. We strive to describe products
accurately (including materials, sizes, and imagery). Colors and finishes may vary slightly due to screen settings,
photography, and manufacturing tolerances.
Prices are shown in the currency indicated on the Site and may change without notice before you complete checkout.
We reserve the right to correct pricing errors. If an error is discovered after you place an order, we may cancel
the order and refund any amount charged, or contact you for instructions.
Product availability is not guaranteed. We may limit quantities, discontinue items, or refuse orders that appear to be bulk or resale purchases without prior written approval.
Content on the Site (including quotations from classical authors, reflections, and educational materials) is for
inspiration and general information. It is not professional advice (medical, legal, financial, therapeutic, or otherwise).
5. Orders, payment, and taxes
Placing an order constitutes an offer to purchase. We may accept or decline any order. Order confirmation emails
acknowledge receipt of your offer; a contract is formed when we accept the order and process payment or ship the goods.
You authorize us (and our payment processors) to charge your selected payment method for the total amount due,
including product price, shipping, and applicable taxes. You represent that you are authorized to use the payment method provided.
Sales tax, VAT, duties, or similar charges may apply based on your shipping destination and local law.
You are responsible for any import duties or customs fees not collected at checkout.
Fraudulent, abusive, or high-risk transactions may be canceled. We may request additional verification before fulfilling an order.
6. Shipping and delivery
Shipping methods, costs, and estimated delivery times are presented at checkout and in our Shipping Policy.
Delivery dates are estimates only. We are not liable for delays caused by carriers, customs, weather, or events outside our reasonable control.
Risk of loss and title for products pass to you upon delivery to the carrier, except where mandatory consumer law provides otherwise.
Please inspect packages promptly and report damage or shortage as described in our shipping or returns materials.
You are responsible for providing a complete and accurate shipping address. Orders returned due to incorrect addresses,
failed delivery, or refusal may be subject to reshipping fees or partial refunds after deduction of costs.
7. Returns, refunds, and exchanges
Returns, refunds, and exchanges are governed by our Refund / Return Policy
(available on the Site and/or at checkout)
.
Unless required by law or stated otherwise in that policy, eligible items may generally be returned within the stated window
if unused, in original condition, and with tags attached where applicable.
Certain items may be non-returnable (for example, personalized goods, final-sale items, or journals that have been written in),
except where defective or not as described. Refunds are typically issued to the original payment method after we receive and inspect the return.
8. Intellectual property
The Site and all content we provide—including logos, trademarks, product designs, artwork, text, graphics, photographs,
layout, and software—are owned by The Providence Forge or our licensors and are protected by copyright, trademark,
and other intellectual property laws.
You may access the Site for personal, non-commercial use. You may not copy, reproduce, modify, distribute, sell,
scrape, reverse engineer, or create derivative works from our content or designs without our prior written permission,
except for limited personal use of materials we expressly allow (for example, sharing a product page link).

and are used for educational and reflective purposes.
9. Reviews, comments, and user content

worldwide, royalty-free, perpetual license to use, reproduce, modify, publish, and display that content in connection
with operating and promoting the Site and Services.
You represent that your User Content is accurate to the best of your knowledge, does not violate any law or third-party rights,
and is not defamatory, obscene, harassing, or otherwise objectionable. We may remove User Content at our discretion.

We may suspend or terminate access for prohibited conduct.
11. Third-party services and links
The Site is powered by Shopify and may use third-party services for payments, shipping, analytics, email, reviews, or advertising.
Your use of those services may be subject to additional terms. We are not responsible for third-party websites or services
linked from the Site.
Payment processing is handled by Shopify Payments and/or other processors. We do not store full payment card numbers on our servers
when processing is handled by those providers.
12. Privacy
Our collection and use of personal information is described in our Privacy Policy
(available on the Site)
.
By using the Site, you acknowledge that policy. Where required by law, we will obtain consent for certain processing activities.
13. Electronic communications
When you use the Site, create an account, place an order, or contact us, you consent to receive electronic communications
from us (order updates, transactional messages, and—if you opt in—marketing). You may unsubscribe from marketing emails
at any time using the link in those messages. Transactional messages related to your orders may still be sent.
14. Disclaimers
TO THE FULLEST EXTENT PERMITTED BY LAW, THE SITE AND SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES
OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A
PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
We do not warrant that the Site will be uninterrupted, secure, or error-free, or that defects will be corrected.
Product information and content are provided for general purposes and do not constitute professional advice.
Some jurisdictions do not allow exclusion of certain warranties; in those jurisdictions, our liability is limited to the maximum extent permitted by law.
15. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, THE PROVIDENCE FORGE AND ITS OWNERS, OFFICERS, EMPLOYEES, AGENTS,
AND SUPPLIERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES,
OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE OR SERVICES,
WHETHER BASED IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR OTHERWISE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
TO THE FULLEST EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS
OR THE SERVICES SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US FOR THE PRODUCTS GIVING RISE TO THE CLAIM
IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS (USD $100).
Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law
(including liability for death or personal injury caused by negligence, or for fraud).
16. Indemnification
You agree to defend, indemnify, and hold harmless The Providence Forge and its owners, officers, employees, and agents
from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees)
arising out of or related to: (a) your use of the Site or Services; (b) your User Content; (c) your violation of these Terms;
or (d) your violation of any law or third-party rights.
17. Force majeure
We are not liable for any failure or delay in performance due to circumstances beyond our reasonable control,
including acts of God, natural disasters, war, terrorism, labor disputes, utility failures, epidemics, government actions,
carrier disruptions, or supply-chain interruptions.
18. Governing law and disputes
These Terms are governed by the laws of the State of New York, United States, without regard to conflict-of-law principles,
except where mandatory consumer protection laws of your place of residence require otherwise.
Before filing a formal claim, you agree to contact us at
admin@theprovidenceforge.com
and attempt to resolve the dispute informally for at least thirty (30) days.
Subject to mandatory consumer rights, exclusive venue for disputes shall be the state or federal courts located in
the State of New York, United States, and you consent to personal jurisdiction there.
If you are a consumer in a jurisdiction that grants you the right to bring claims in your local courts,
nothing in these Terms limits that right where it cannot be waived.
19. Changes to these Terms
We may update these Terms from time to time. The “Effective date” at the top of this page will be revised when changes are posted.
Material changes may also be communicated by notice on the Site or by email when appropriate.
Continued use of the Site after changes become effective constitutes acceptance of the revised Terms.
If you do not agree, stop using the Site and Services.
20. General
Entire agreement. These Terms, together with policies referenced herein and any order-specific terms at checkout,
constitute the entire agreement between you and us regarding the Site and Services and supersede prior agreements on that subject.
Severability. If any provision is held unenforceable, the remaining provisions will remain in full force and effect.
Waiver. Failure to enforce any provision is not a waiver of our right to enforce it later.
Assignment. You may not assign these Terms without our consent. We may assign them in connection with a merger,
acquisition, or sale of assets.
No third-party beneficiaries. These Terms do not create rights for any third party except as expressly stated.
